This English translation is provided for your convenience. The contract language is German; in the event of any discrepancy, the German version shall prevail.

GENERAL TERMS AND CONDITIONS – MoNature

OVERVIEW

Welcome to MoNature. The terms “we”, “us” and “our” refer to MoNature, owner: Mona Espinoza López, Oberstraße 3, 47829 Krefeld, Germany. We operate this online shop at monature-cosmetics.com.

These General Terms and Conditions (“Terms”) apply to all contracts concluded via our online shop. The version valid at the time of the order is decisive.

The contract language is German.

SECTION 1 – CUSTOMER ACCOUNT

Orders can be placed with or without a customer account. Orders require truthful, complete and up-to-date information.

If you create a customer account, you are responsible for keeping your login details confidential. Passing on the customer account to third parties is not permitted.

SECTION 2 – PRODUCT PRESENTATION

We strive to present our products as accurately as possible. Deviations in colour or appearance may occur for technical reasons.

Statutory warranty rights remain unaffected.

SECTION 3 – CONCLUSION OF CONTRACT

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

You place the desired products in the cart and proceed via the checkout to enter your contact, delivery and payment details. Before submitting your order, you receive an overview in which you can check all details and correct them using your browser’s back function or the edit fields in the checkout.

By clicking the order button in the final step of the checkout (e.g. “Pay now”), you submit a binding offer to purchase the goods in the cart. We confirm receipt of your order immediately by email (order confirmation). The purchase contract is concluded with this email.

Storage of the contract text

We store the contract text. We send you the order details by email with the order confirmation. You can view and save these Terms on this page at any time. If you have created a customer account, you can view your orders there.

SECTION 4 – PRICES AND SHIPPING COSTS

All prices stated are final prices. In accordance with § 19 of the German VAT Act (small business regulation), no VAT is charged or shown.

Any additional shipping costs are displayed in the checkout before the order is completed. For details, please see our shipping policy.

SECTION 5 – PAYMENT

The following payment methods are available in our shop:

  • Credit and debit card (including Visa, Mastercard, Maestro) as well as Apple Pay, Google Pay and Shop Pay: processed via Shopify Payments. Your card is charged when the order is completed.
  • PayPal: during checkout you are redirected to the PayPal website, where you confirm the payment. You are charged when the order is completed.
  • Klarna: payment is processed via Klarna Bank AB (publ), Stockholm. Which Klarna payment options (e.g. pay now, invoice or instalments) are offered to you is shown in the checkout. Klarna’s terms of use also apply; Klarna may carry out a credit check.
  • Gift cards from MoNature can be redeemed in the checkout.

The payment methods available in each case are displayed in the checkout before the order is completed. Goods are shipped after receipt or confirmation of payment.

SECTION 6 – DELIVERY AND TRANSFER OF RISK

We deliver exclusively within Germany. Delivery takes 2–4 working days after receipt of payment, unless otherwise stated for the respective product.

For consumers, the risk of accidental loss or deterioration of the goods only passes on handover to the customer.

SECTION 7 – RIGHT OF WITHDRAWAL

Consumers have a statutory right of withdrawal. Details can be found in our cancellation policy.

SECTION 8 – WARRANTY

The statutory rights for defects apply.

SECTION 9 – INTELLECTUAL PROPERTY

All content on this website (texts, images, logos, graphics, designs) is protected by copyright. Any use beyond private use is not permitted without our prior written consent.

SECTION 10 – REVIEWS AND CONTENT

If you send us content (e.g. reviews, texts, images), you grant us the non-exclusive, free right to use this content for display in the online shop and for marketing purposes. You may withdraw this consent at any time with effect for the future.

SECTION 11 – LIABILITY

We are liable without limitation for intent, gross negligence, injury to life, body or health and under the German Product Liability Act.

In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded to the extent permitted by law.

SECTION 12 – DATA PROTECTION

Information on the processing of personal data can be found in our privacy policy.

SECTION 13 – DISPUTE RESOLUTION

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

SECTION 14 – FINAL PROVISIONS

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
